1. Agreement and Who These Terms Cover

These Terms and Conditions apply to every residential and commercial service provided by Snake River Driveways (\"we,\" \"us,\" \"our\"), based in Wilder, Idaho. \"You\" means the property owner, or the owner's authorized representative, who approves the work.

These Terms are part of every estimate, quote, and invoice we issue. You accept them when you approve a quote online, sign a quote, or pay a deposit. If your approved quote and these Terms ever conflict, the quote controls for that job.

Idaho Contractor Registration No.: [to be added]

Phone: 208-869-8476

Website: snakeriverdriveways.com

2. Our Services

We specialize exclusively in gravel driveway repair and restoration. This includes pothole and rut repair, washout repair, regrading, water management and drainage shaping, compaction, and gravel replenishment.

The following are not offered and are never included in any quote:

New driveway installation
Asphalt or concrete work
Seal coating or chip seal
Any other paving

Work not written on your approved quote is outside the scope of the job unless added through a change order (Section 4).

Gravel is a natural, loose surface. Some settling, gravel migration, and light surface wear over time are normal and expected, even on a well-repaired driveway.

3. Estimates and Pricing

Every estimate is written, itemized, and based on the conditions visible during our property walkthrough.

\nValidity: Estimates are valid for 60 days from the date issued. After 60 days, pricing may be updated to reflect current material, fuel, and delivery costs.
\nProject pricing: Every job is priced according to the scope of work needed to complete the job correctly.
\nMaterial hauling: Material delivery and hauling services are outsourced to a 3rd party, therefore, we have no control on hauling pricing.
\nMaterials: Gravel is estimated and priced by the cubic yard. If the job requires more material than estimated, the additional material is billed at the per-yard rate shown on your quote.

4. Hidden Conditions and Change Orders

No additional work is ever performed without your written or electronic approval.

Some conditions cannot be seen until work begins, such as soft or saturated subgrade, buried rock or debris, old concrete or asphalt, hidden drainage problems, or unmarked buried lines. If we find one, we will:

Pause the affected portion of the work.
Show you the condition and explain your options.
Provide a written change order describing the added scope and price.
Proceed only after you approve the change order.

If you decline a recommended change, we will complete the original scope where reasonably possible. We are not responsible for later problems caused by a condition you chose not to correct. Changes you request during the job follow the same change order process.

5. Deposits and Payment

A 25% deposit reserves your date, and the remaining balance is due when the work is complete.

\nDeposit: 25% of the quoted total, applied in full toward your final invoice.
\nFinal payment: Due upon completion of the job, unless you choose the extended payment plan below.
\nExtended payment plan (optional): Instead of paying the full balance at completion, you may choose our extended payment plan, which gives you 56 days from completion to pay your invoice in full. You may pay the balance in one payment or several payments at any time within the 56 days. To choose the extended payment plan, you must have a credit or debit card or ACH bank account on file with us; checks and cash are not accepted. Any plan balance still unpaid 56 days after completion is charged the $250 late fee below.
\nPayment methods: Credit or debit card (securely through Jobber), ACH bank transfer, check, or cash.
\nLate fee: Any balance unpaid 56 days after completion is charged a $250 late fee. An additional $250 is charged every 28 days afterward until the balance is paid in full.
\nReturned checks: A returned or dishonored check is charged a $20 fee, the maximum allowed under Idaho law, and the full balance must then be paid by card, ACH, or cash.

6. Scheduling, Weather, and Cancellations

Your date is reserved once we receive your deposit, and changes require 48 hours' notice.

\nCancelling or rescheduling: Give us at least 48 hours' notice. With 48 or more hours' notice, your deposit is refundable. With less than 48 hours' notice, the deposit is non-refundable.\n
\nWeather: Rain, snow, frozen ground, or saturated soil can prevent quality work. We may reschedule for weather at no charge, and your deposit carries over to the new date.
\nClear access: On the scheduled day, the work area must be clear of vehicles, trailers, equipment, and other obstacles. Gates must be unlocked and pets secured. We are not responsible for damage to vehicles, equipment, or other property left in or near the work area if it has not been properly cleared.
\nAccess delays: If the work area cannot be cleared within 1 hour of our arrival, a $250 reschedule fee applies and the job is moved to the next available date.
\nOur delays: If we must reschedule because of equipment, supplier, or other issues on our end, we will notify you as soon as possible and offer the next available date.

7. Your Responsibilities

A few items are yours to handle before we arrive, and they protect both your property and your timeline.

\nAuthority to approve: You confirm you own the property or are authorized to approve the work. For shared driveways, easements, rentals, or HOA properties, you are responsible for obtaining any needed permission. We confirm this with you during the property walkthrough.
\nProperty lines: You are responsible for identifying property boundaries. We work only within the area you identify.
\nPublic utilities: We request public utility locates through Idaho's one-call system before any excavation.
\nPrivate lines: Public locates do not mark privately owned lines. You are responsible for marking all private underground items before work begins, including sprinkler and irrigation lines, septic tanks and drain fields, private power or gas lines to shops and outbuildings, well lines, invisible pet fences, and low-voltage lighting. We are not responsible for damage to private lines that were not marked or disclosed.
\nKnown issues: Please tell us about any known drainage problems, soft spots, or buried items.

8. Property Protection and Limits of Responsibility

We treat your property with care, and we will repair any damage caused by our own negligence.

Driveway work requires heavy equipment and loaded delivery trucks. Some incidental effects outside the work area are normal, and we are not responsible for:

Tire tracks, turf marks, or minor ruts along the access route to the work area
Damage to curbs, sidewalks, culverts, landscaping, or other surfaces not built to support equipment or delivery truck weight, along the route you approve
Damage to septic systems, drain fields, or other buried items not disclosed to us
Cracking or settling of existing concrete or asphalt next to the work area

To the extent permitted by law, our total responsibility for any claim related to a job is limited to the amount you paid for that job.

9. 6-Month Workmanship Warranty

We stand behind our work with a 6-month workmanship warranty, starting on the date the job is completed.

If a defect in our workmanship appears during that time, such as failed grading or compaction under normal use, contact us. We will inspect it and correct any workmanship defect at no charge for labor or materials. The warranty takes effect once the job is paid in full.

The warranty does not cover damage or wear caused by:

Snowplows or snow removal equipment
Severe or excessive weather
Flooding
Irrigation flooding, overspray, or runoff
Heavy trucks or equipment beyond normal driveway use
Improper maintenance, or alterations made by others
Normal gravel settling, migration, and surface wear

An extended 6-month warranty is available.

10. Photos and Marketing

We photograph every job before, during, and after the work to document conditions and quality.

We may use these photos on our website, social media, and other marketing. We will never show your address, house, house numbers, license plates, people, or other details that could identify your property.

You may opt out at any time by telling us by text, email, or in writing. We will stop any future use of your photos once we receive your request.

11. Disputes, Governing Law, and General Terms

If something is not right, call us first; most concerns are resolved with a conversation on site.

\nResolving concerns: Both parties agree to discuss any dispute in good faith. If it is not resolved within 30 days, both parties agree to try mediation in Canyon County, Idaho, before filing a lawsuit. Small claims actions are not affected.
\nGoverning law: These Terms are governed by the laws of the State of Idaho.
\nRequired disclosures: For residential jobs over $2,000, you will receive the contractor disclosure statement required by Idaho Code § 45-525 before the contract is signed.
\nInsurance: Proof of our general liability insurance is available on request.
\nOregon work: Services in Oregon are provided only where Snake River Driveways holds the required Oregon license.
\nSeverability: If any part of these Terms is found unenforceable, the rest remain in effect.
\nUpdates: We may update these Terms. The version in effect when you approve your quote applies to that job.
